Kenya's employment framework includes the Employment Act 2007, NSSF pension contributions (new tiered rates from 2024), the new SHIF health fund (replacing NHIF), and the Affordable Housing Levy. An Employer of Record (EOR) handles these evolving requirements.
Why Use an EOR in Kenya?
Evolving social security. NSSF contributions increased significantly under the tiered system (Year 4 rates from February 2026: up to KES 6,480/month each for employer and employee). The new SHIF replaced NHIF in October 2024. An EOR tracks these changes.
Affordable Housing Levy. A mandatory 1.5% contribution from both employer and employee was introduced in 2024 — adding to payroll complexity.
Entity setup complexity. Registering a foreign company in Kenya takes 3-6 weeks and involves the Business Registration Service, KRA, NHIF/SHIF, and NSSF.
Strong termination protections. The Employment Act requires fair process for dismissals. Severance of 15 days' pay per year of service applies for redundancy.

EOR Costs in Kenya
Most EOR providers charge $300 to $500 per employee per month. Statutory employer costs add about 7.5-8% on top of salary: NSSF at 6% of pensionable pay up to KES 108,000 (Year 4 rates from February 2026, maximum KES 6,480 a month), the Affordable Housing Levy at 1.5% of gross and the NITA levy of KES 50 a month. SHIF at 2.75% is an employee-only deduction, and Kenya has no statutory 13th month.
